SCUBA diving, snorkeling, and all related activities offered by Deep Blue Diving Dominica ("the Operator") involve inherent risks, including but not limited to decompression sickness, drowning, barotrauma, marine life injury, equipment malfunction, and other risks that may result in serious injury, permanent disability, or death. By checking the box below, I confirm that I understand and voluntarily accept these risks.

1. Assumption of Risk. I acknowledge that diving and snorkeling are activities with inherent and significant risks which cannot be eliminated regardless of the care taken. I am voluntarily participating with knowledge of the danger involved, and I hereby agree to accept any and all risks of injury, illness, or death.

2. Medical Fitness. I confirm that I am physically fit to dive, that I have no medical condition that would make diving unsafe for me, and that I have truthfully disclosed any relevant medical information to the Operator. I understand that diving is not recommended for individuals with certain medical conditions.

3. Release of Liability. In consideration of being allowed to participate, I, on behalf of myself, my heirs, assigns, executors, and legal representatives, hereby release, waive, discharge, and covenant not to sue Deep Blue Diving Dominica, its owners (Jennifer and Uwe Fandrich), employees, instructors, divemasters, boat operators, and affiliated businesses (collectively, "the Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of my participation, whether caused by negligence of the Released Parties or otherwise, to the fullest extent permitted by applicable law.

4. Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my presence or participation, whether caused by negligence or otherwise, to the fullest extent permitted by applicable law.

5. International Applicability. This waiver and release is intended to apply regardless of the participant's nationality or country of residence, and is governed in addition to, and not in place of, any mandatory consumer-protection or liability laws of the jurisdiction in which it is signed or which otherwise apply and cannot be waived. If any clause of this waiver is found unenforceable under the laws of a given jurisdiction, the remaining clauses shall remain in full force and effect, and the unenforceable clause shall be interpreted to give maximum effect permitted by law.

6. Equipment. I understand that all equipment provided is regularly inspected and maintained, but I accept that no mechanical or safety equipment is entirely free of risk of failure.

7. Acknowledgement. I confirm that I have read this entire waiver, fully understand its terms, understand that I am giving up substantial legal rights by signing it, and sign it freely and voluntarily without any inducement.
